Terms of Service

Pixel72 is a software product operated under the registered business name Nexo72studio, a sole proprietorship based in California, United States ("Pixel72," "we," "us," or "our").

These Terms of Service ("Terms") govern your access to and use of the Pixel72 website, applications, analytics platform, and related services, including its analytics dashboards and AI-assisted features (collectively, the "Service").

By creating an account, accessing the Service, or using the Service on behalf of an organization, you agree to these Terms. If you use Pixel72 on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

If you do not agree, you must not use the Service.

Pixel72 is a cloud-based analytics platform designed to help organizations understand and analyze Amazon Connect contact center operations.

The Service may provide:

• Operational and leadership dashboards
• Contact center performance analytics
• Workforce and supervisor insights
• AI-assisted analysis and natural-language queries
• Saved analyses and reporting
• Related administrative and account management capabilities

Features may change as the Service evolves. Certain capabilities may depend on your subscription, configuration, AWS permissions, and availability of underlying data.

You must be legally capable of entering into a binding agreement to use the Service.

You agree to provide accurate account information, maintain authorized access to your email account, and promptly notify Pixel72 of suspected unauthorized account activity.

Pixel72 may use passwordless authentication, including email-based one-time verification codes.

Your organization is responsible for managing authorized users, assigning appropriate permissions, and ensuring users comply with these Terms.

Pixel72 integrates with customer-authorized AWS resources to provide Amazon Connect analytics.

Customers are responsible for configuring and maintaining the AWS permissions, roles, and resources required for the Service.

Pixel72's intended architecture uses customer-authorized, scoped access to query analytics resources within the customer's AWS environment.

Underlying source analytics data remains within the customer's AWS environment. Pixel72 may process query results and store certain application information, including account configuration, dashboard definitions, saved analyses, and conversation history, as necessary to provide the Service.

Customers retain ownership of their data.

Customers grant Pixel72 the limited rights necessary to access and process customer-authorized data to operate, maintain, secure, and support the Service.

Pixel72 will not intentionally modify underlying Amazon Connect source data as part of its standard analytics functionality.

Customers remain responsible for their AWS account, applicable AWS charges, data access permissions, and compliance obligations.

Certain Pixel72 features require a paid subscription.

Subscription pricing, licensed-user quantities, billing intervals, and applicable commercial terms are presented during checkout or in a separate written agreement.

For self-service subscriptions:

• Subscription charges are processed through the designated payment provider.
• Recurring subscriptions renew according to the billing terms accepted at checkout unless canceled.
• Subscription changes, including additional licensed users, may affect charges.
• Reductions in licensed users may take effect at a later billing period, as disclosed during the applicable change process.
• Applicable taxes may be added where required.

Unless otherwise stated in an applicable order or required by law, payments are non-refundable.

Enterprise or annually contracted subscriptions may be governed by additional written commercial terms. Where an executed agreement conflicts with these Terms, the executed agreement controls for the subject matter of that conflict.

Pixel72 may offer eligible customers a 14-day free trial.

Trial availability, duration, included features, and any payment requirements are subject to the terms presented during registration or checkout.

If a trial converts to a paid subscription, applicable billing terms and the date of the first charge must be disclosed during signup.

Customers are responsible for canceling before a paid billing period begins if they do not wish to continue, where automatic conversion applies.

Pixel72 may limit trial eligibility to prevent abuse.

You agree not to:

• Access the Service without authorization
• Attempt to bypass authentication, tenant isolation, or access controls
• Interfere with Service availability, security, or performance
• Introduce malware or malicious code
• Reverse engineer the Service except where permitted by law
• Use the Service to violate applicable laws or third-party rights
• Submit data you are not authorized to access or process
• Attempt to extract another customer's information
• Use automated tools to overload or abuse the Service

Pixel72 may restrict or suspend access when reasonably necessary to protect the Service, customers, or other users.

Pixel72 may provide AI-assisted capabilities to help interpret analytics information and generate explanations or summaries.

AI-generated results may be incomplete, inaccurate, or dependent on the quality and availability of underlying data.

Customers should independently evaluate outputs before making material operational, employment, financial, or business decisions.

AI-assisted functionality is intended to support human judgment, not replace it.

The processing of customer information through AI-assisted features is governed by applicable service configurations, security controls, and privacy commitments.

Pixel72 and its licensors retain all rights, title, and interest in the Service, including its software, designs, trademarks, documentation, and proprietary technology.

Subject to these Terms and applicable payment obligations, Pixel72 grants customers a limited, non-exclusive, non-transferable right to access and use the Service for their internal business purposes during the applicable subscription period.

Customers retain ownership of their own data and materials.

Nothing in these Terms transfers ownership of customer data to Pixel72.

Each party agrees to use reasonable care to protect the other party's non-public confidential information received in connection with the Service.

Pixel72 maintains technical and organizational safeguards intended to protect the information it processes.

No internet-based service can guarantee absolute security.

Customers are responsible for maintaining appropriate AWS configurations, user permissions, and internal security controls.

Additional confidentiality, security, or data processing obligations may be established in a separate written agreement.

Pixel72 seeks to provide reliable service but does not guarantee uninterrupted or error-free availability.

The Service may be temporarily unavailable due to maintenance, infrastructure issues, third-party dependencies, or circumstances beyond Pixel72's reasonable control.

Pixel72 may update, improve, or modify features from time to time.

Any separately agreed service-level commitments will govern where applicable.

Customers may cancel subscriptions through available account billing controls or other methods specified in their agreement.

Cancellation stops future renewal according to the applicable billing terms but does not automatically entitle the customer to a refund.

Pixel72 may suspend or terminate access for material violations of these Terms, nonpayment, unlawful activity, or serious security risks, subject to applicable contractual obligations.

Upon termination, access to the Service may end. Retention and deletion of information will follow applicable legal requirements, contractual obligations, and the Privacy Policy.

Pixel72 relies on third-party services and infrastructure, which may include Amazon Web Services, Amazon Connect, and Stripe.

Customers may be subject to separate terms governing their use of these third-party services.

Pixel72 is not responsible for outages, configuration changes, or service limitations caused by third-party systems outside its reasonable control.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," EXCEPT AS EXPRESSLY PROVIDED IN A SEPARATE WRITTEN AGREEMENT.

PIXEL72 DISCLAIMS IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT TO THE EXTENT PERMITTED BY LAW.

PIXEL72 DOES NOT GUARANTEE THAT ANALYTICS, REPORTS, OR AI-ASSISTED OUTPUTS WILL BE ERROR-FREE OR SUITABLE FOR EVERY BUSINESS DECISION.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NEITHER PARTY WILL BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR BUSINESS OPPORTUNITIES ARISING FROM THESE TERMS OR THE SERVICE.

EXCEPT FOR LIABILITIES THAT CANNOT LAWFULLY BE LIMITED OR EXCLUDED, EACH PARTY'S TOTAL AGGREGATE LIABILITY ARISING FROM THESE TERMS OR THE SERVICE WILL NOT EXCEED THE FEES PAID OR PAYABLE BY THE CUSTOMER TO PIXEL72 DURING THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

The scope of exceptions, exclusions, and liability caps is subject to legal review and any separately executed agreement.

These Terms are governed by the laws of the State of California, United States, without regard to conflict-of-law principles.

Any dispute resolution procedures, venue requirements, or additional remedies will be governed by applicable law and any separately executed agreement.

Pixel72 may update these Terms to reflect changes in the Service, business practices, or legal requirements.

Material changes will be communicated through reasonable notice, which may include email or notices within the Service.

The updated Terms will identify their effective date.

Where required by law, Pixel72 will obtain additional consent before updated Terms become binding.
